1. Acceptance of Terms

By accessing or using Once Upon a Workday (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service. If you are using the Service on behalf of a minor, you represent that you are the child’s parent or legal guardian and accept these terms on their behalf.

2. Description of Service

Once Upon a Workday is an AI-powered platform that generates personalized bedtime stories for children of working parents. The Service includes story generation, AI illustration, voice recording, a community library, and related features.

3. Account Registration

  • You must be at least 18 years old to create an account
  • You must provide accurate and complete registration information
  • You are responsible for maintaining the security of your account credentials
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized use of your account

4. Subscription Plans and Payment

  • We offer both free and paid subscription plans
  • Paid plans are billed monthly through Stripe
  • You may upgrade, downgrade, or cancel your subscription at any time
  • Downgrades and cancellations take effect at the end of the current billing period
  • Refunds are handled on a case-by-case basis; contact us for assistance
  • We reserve the right to change pricing with 30 days’ advance notice
  • Story limits reset monthly; unused stories do not roll over
  • Bonus stories earned through referrals expire as described in our referral program terms

5. Content and Intellectual Property

Your Content

  • You retain ownership of all content you provide (photos, voice recordings, family information)
  • You grant us a limited license to use your content solely to provide the Service
  • When you publish a story to the community library, you grant other users permission to read it
  • You may unpublish or delete your content at any time

Generated Content

  • Stories and illustrations generated by the Service are created for your personal, non-commercial use
  • You may share generated stories with family and friends
  • You may not resell, redistribute, or commercially exploit generated content
  • We do not claim ownership of stories generated for you

Our Content

The Service, its design, features, and underlying technology are owned by Once Upon a Workday and protected by intellectual property laws. You may not copy, modify, or reverse engineer any part of the Service.

6. Acceptable Use

You agree not to:

  • Upload content that is harmful, abusive, or inappropriate for children
  • Upload photos of individuals without their consent (or parental consent for minors)
  • Attempt to generate stories with violent, sexual, or otherwise inappropriate content
  • Use the Service to harass, bully, or harm others
  • Interfere with or disrupt the Service or its infrastructure
  • Create multiple accounts to circumvent story limits or abuse referral bonuses
  • Use automated tools to access the Service without our permission
  • Violate any applicable laws or regulations

7. Content Moderation

We use AI-powered moderation to review uploaded photos and voice recordings for safety and appropriateness. Content that violates our guidelines may be flagged, rejected, or removed. We reserve the right to remove any content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable.

8. Community Library

  • Publishing a story to the library is voluntary and requires your explicit consent
  • Published stories may be read and rated by other users
  • You may unpublish your story at any time
  • We reserve the right to remove stories from the library that violate our guidelines
  • Ratings and reviews must be honest and respectful

9. AI-Generated Content Disclaimer

Stories and illustrations are generated by artificial intelligence. While we strive for high quality and appropriateness, AI-generated content may occasionally be imperfect, inaccurate, or unexpected. We review and moderate AI outputs, but we cannot guarantee that all generated content will meet every user’s expectations. If you encounter inappropriate content, please report it to us immediately.

10. Limitation of Liability

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Account Termination

  • You may delete your account at any time from your profile settings
  • We may suspend or terminate accounts that violate these Terms
  • Upon termination, your personal data will be deleted within 30 days
  • Provisions that by their nature should survive termination will survive

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice on the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law provisions. Any disputes shall be resolved in the courts located in Bexar County, Texas.
